Syracuse Chapter Annual Taxation, and A&A Update

Gerry Stack focuses his practice on tax and corporate matters as well as estate planning. Gerry provides guidance on a wide range of corporate and tax matters including mergers and acquisitions, structuring like-kind exchanges, drafting complex joint ventures, and succession planning. Gerry’s clients include large real estate developers with multistate real estate holdings, energy companies, large family-owned businesses, individuals in need of sophisticated estate planning, and not-for-profit entities. Gerry also has a significant tax controversy practice both on the federal and state level. Gerry is heavily involved with firm administration and is General Counsel for the firm.

Jamie is a Partner in Bonadio’s Commercial division in our Syracuse office. She has comprehensive experience in financial and treasury management, business and operational analysis, audits of internal controls over financial reporting (ICOFR) and audits of financial statements of both public and private entities (including single-employer and multi-employer employee benefit plans). Jamie began her career with KPMG in Harrisburg, Pa. Following her tenure with KPMG, she served as a business and corporate financial analyst for a Pennsylvania-based global manufacturer. She also served as CFO and Comptroller for a community bank, and most recently, as Senior Manager of Audit and Accounting Services in the Syracuse office of a Mid-Atlantic CPA firm. It was in this capacity where she established herself as a specialist in audits of ICOFR and audits of financial statements of both Securities and Exchange Commission (SEC) and private risk based audit engagements; review of commercial credit relationships; review of investments securities for other-than-temporary impairment and review of SEC filings. Jamie is a licensed CPA in New York, Pennsylvania, and Maryland. She received her B.S.B.A. in Accounting from Shippensburg University. She is a member of the American Institute of Certified Public Accountants and the New York State Society of Certified Public Accountants, serving as the Syracuse Chapter’s Secretary and Career Opportunities in Accounting Program (COAP) Committee Chair. She is also a member of the Board of Directors of the Empire Chapter of the Risk Management Association (RMA).

Marion Hancock Fish is a partner in the Trusts & Estates, Family Business Succession Planning, Tax, Corporate and Elder Law & Special Needs Practices. She focuses her practice on representing clients in matters involving estate planning, transfer-of-wealth tax issues, family business planning and succession, charitable giving, not-for-profit law and elder law and special needs administration. Ms. Fish works with clients to develop comprehensive plans, and manages the implementation of these plans for effective and efficient estate and trust funding and administration, using a team approach to address all aspects of estate and tax planning, and administration. Having worked with numerous family business owners, Ms. Fish has a significant level of experience developing plans for successful business transition to minimize transfer tax costs and to position businesses for continued success. She also partners with other professionals, including accountants, financial planners, corporate trustees and business valuation experts, both locally and nationally. Ms. Fish works with those professionals to address matters such as business valuation; retirement planning; life insurance; estate, gift and income tax planning; and tax audit matters.

Joe counsels clients on a wide range of state and local taxation issues and represents taxpayers in disputes with the New York State Department of Taxation and Finance as well as the New York City Department of Finance. As the Sales & Use Tax Practice Leader, Joe’s practice focuses on sales and use tax issues, especially in the technology (software as a service, cloud computing, digital products, etc.), fine arts and construction industries. Joe is the primary author of our firm’s sales tax blog, All About Sales Tax. Joe is a contributing editor (New York Chapter) of the American Bar Association's Sales and Use Tax Deskbook. Joe also counsels clients regarding personal income tax planning and residency issues. He co-authored, with Mark S. Klein, the 2019 Guidebook to New York Taxes, a reference source of information on this topic and he writes a column for Tax Notes State called “The Endres Assessment." He also advises clients with respect to various federal and state tax incentive-based programs such as the federal renewable energy investment and production tax credits, New York State's Start-Up NY Program, the Excelsior Program, the former Empire Zone Program, the Brownfield Tax Credit Program and the Historical Building Rehabilitation Tax Credit Program. As the Abandoned Property Audits Practice Leader, Joe counsels clients in this area of law and has represented large corporations in complex compliance matters such as multistate abandoned property audits and voluntary disclosures.

Jim practices in a wide range of domestic and international tax areas. Jim is the leader of the firm’s Tax Dispute Resolution Practice and he regularly assists clients with tax controversies with the Internal Revenue Service and the New York State Tax Department, including in domestic and offshore voluntary disclosure matters. He has helped hundreds of clients avoid or minimize penalties when coming into compliance with foreign account and asset reporting requirements, such as the FBAR and IRS Forms 926, 3520, 3520-A, 5471, 5472, and 8938. Jim also frequently handles matters before the U.S. Tax Court. In addition, he advises international clients on the U.S. tax implications of the loss of U.S. citizenship and lawful permanent resident (“green card”) status and on issues under the Foreign Account Tax Compliance Act (FATCA) and U.S. anti-deferral tax regimes, such as the controlled foreign corporation (CFC) and passive foreign investment company (PFIC) rules. He also regularly counsels clients on tax and corporate issues related to business operations, acquisitions, and sales, as well as advantageous business structures for tax planning purposes.
